In these terms and conditions “we” means Mhc Digital Limited and “our” and “us” shall have the corresponding meaning; “you” shall mean you the customer and “your” shall have the corresponding meaning.

5. Scope of Mhc Services

5.1 Mhc is a service platform which purpose is the provision of a marketplace for medical service providers including but not limited to hospitals and clinics (“Providers”)

5.2 MEDIGO does not refer the User or other patients to specific Providers but only provides information about Providers based on the User’s needs, i.e. time frame of availability, geographic area, medical needs, etc. Thus, the User will not be allocated to any Provider but will instead be provided with a list of Providers (including the name, address, specialization, etc.) of which the User can choose one and book an appointment with.

5.3 Mhc discloses details and information on Providers based on data, either provided by the Providers or collected and curated from online and offline information from a variety of sources. Although Mhc uses reasonable skill and care in performing the Services it will not verify if, and cannot guarantee that, all information provided is accurate, complete or correct, nor can Mhc be held responsible for any errors (including manifest and typographical errors), inaccurate, misleading or untrue information provided by the Providers or non-delivery of information by the Providers. The website does not constitute and should not be regarded as a recommendation or endorsement of the quality, service level or qualification of any Provider.

5.4 Mhc channels and thereby facilitates the communication between the User and Providers. In particular, Mhc provides different forms the User may use in order to enquire about the Provider’s medical services. Should the User and the Provider decide to conclude a contract, Mhc is not involved in the contractual relationship between the User and the Provider and also in no way influences the conclusion or the content of the contract. Mhc does not assume any rights, obligations or liabilities vis-a-vis the User out of a contract concluded between a Provider (or another third party) and the User.

5.5 Mhc does not provide medical services itself. The information provided on the medicalhealthcare.co.uk website including the information provided by the Providers and other third parties cannot replace a medical consultation or a medical examination and shall not be used to independently decide whether to commence or terminate a medical treatment.

6. Conclusion of Contract

6.1 The use of Mhc’s Services requires the User to provide personal contact details in order for Mhc or Providers to be able to assist the User with the medical facilitation services. The User will have to (i) provide his or her full name and phone number, email address and (ii) agree to these Terms and (iii) to Mhc’s privacy policy (“Privacy Policy”).

6.2 Mhc Services are free for the User. The User can, however, solicit additional personal or logistical support or order other additional services for an extra charge. Before ordering a Service for which a charge applies, the exact charge amount will be displayed at the checkout page. The User will be able to review and correct the order data before clicking the button “buy service”.

6.3 With the placement of an order, the User does submit a binding offer to Mhc for the conclusion of a contract concerning the requested Service. The User will then receive an automatic confirmation email regarding the receipt of the electronic order which does not, however, constitute the binding acceptance of the order.

6.4 The User may request to remove their submitted personal, specific personal and medical data from Mhc databases at any time by sending an email to Assistance@medicalhealthcare.co.uk In compliance with the Privacy Policies, Mhc will delete or block the personal data and specific personal data of the User as soon as the User has requested to do so. However, for the purpose of being able to trace and document the history of inquiries of the User or Providers in the event of any legal disputes related to Providers contacted by the User via Mhc’s platform, Mhc will keep the first and the last name of the User and his or her email address. Mhc will not use this data for any other than the aforementioned reason, in particular not for any promotional purposes, after such a request from the User.

7. Restricted access

Access to certain areas of this website is restricted. Mhc reserves the right to restrict access to areas of this website, or indeed this entire website, at Mhc’s discretion.

If Mhc provides you with a user ID and password to enable you to access restricted areas of this website or other content or services, you must ensure that the user ID and password are kept confidential.

Mhc may disable your user ID and password in Mhc’s Sole discretion without notice or explanation.

8. User content

In these terms and conditions, “your user content” means material (including without limitation text, images, audio material, video material and audio-visual material) that you submit to this website, for whatever purpose.

You grant to Mhc a worldwide, irrevocable, non-exclusive, royalty-free license to use, reproduce, adapt, publish, translate and distribute your user content in any existing or future media.  You also grant to Mhc the right to sub-license these rights, and the right to bring an action for infringement of these rights.

Your user content must not be illegal or unlawful, must not infringe any third party’s legal rights, and must not be capable of giving rise to legal action whether against you or Mhc or a third party (in each case under any applicable law).

You must not submit any user content to the website that is or has ever been the subject of any threatened or actual legal proceedings or other similar complaint.

Mhc reserves the right to edit or remove any material submitted to this website, or stored on Mhc’s servers, or hosted or published upon this website.

Notwithstanding Mhc’s rights under these terms and conditions in relation to user content, Mhc does not undertake to monitor the submission of such content to, or the publication of such content on, this website.

 This website is provided “as is” without any representations or warranties, express or implied.  Mhc makes no representations or warranties in relation to this website or the information and materials provided on this website.

Without prejudice to the generality of the foregoing paragraph, Mhc does not warrant that:

  • the information on this website is complete, true, accurate or non-misleading.

10. Limitations of liability

Mhc will not be liable to you (whether under the law of contact, the law of torts or otherwise) in relation to the contents of, or use of, or otherwise in connection with, this website:

  • for any indirect, special or consequential loss; or
  • for any business losses, loss of revenue, income, profits or anticipated savings, loss of contracts or business relationships, loss of reputation or goodwill, or loss or corruption of information or data.

These limitations of liability apply even if Mhc has been expressly advised of the potential loss.

11. Exceptions

Nothing in this website disclaimer will exclude or limit any warranty implied by law that it would be unlawful to exclude or limit; and nothing in this website disclaimer will exclude or limit Mhc’s liability in respect of any:

  • death or personal injury caused by Mhs’d negligence;
  • fraud or fraudulent misrepresentation on the part of Mhc; or
  • matter which it would be illegal or unlawful for Mhc to exclude or limit, or to attempt or purport to exclude or limit, its liability.

13. Other parties

You accept that, as a limited liability entity, Mhc has an interest in limiting the personal liability of its officers and employees.  You agree that you will not bring any claim personally against Mhc’s officers or employees in respect of any losses you suffer in connection with the website.

16. Breaches of these terms and conditions

Without prejudice to Mhc’s other rights under these terms and conditions, if you breach these terms and conditions in any way, Mhc may take such action as Mhc deems appropriate to deal with the breach, including suspending your access to the website, prohibiting you from accessing the website, blocking computers using your IP address from accessing the website, contacting your internet service provider to request that they block your access to the website and/or bringing court proceedings against you.

These Terms are governed by English law. Any dispute arising from, or related to, these Terms shall be subject to the non-exclusive jurisdiction of the courts of England and Wales.
